General terms and conditions of MILPAU Apartments GmbH
The following terms govern booking, payment, stay and use of the apartments offered by MILPAU. They form the contractual basis between MILPAU and the respective guest.
Section 1 Scope and contracting parties
These terms and conditions apply to contracts for the temporary rental of apartments for accommodation purposes as well as to all additional services and deliveries provided by Milpau Apartments GmbH, hereinafter referred to as “MILPAU”, for the guest.
The contracting parties are MILPAU and the guest. If a third party books on behalf of the guest, that third party is jointly and severally liable together with the guest for all obligations arising from the contract.
Subletting or re-letting the apartment, or using it for purposes other than accommodation, in particular for commercial purposes, photo or film shoots or prostitution, requires MILPAU’s prior written consent.
Any deviating terms of the guest only apply if expressly agreed in writing in advance.
Section 2 Booking and conclusion of contract
Booking requests may be submitted via the booking form on the website, in writing by email to info@milpau.de or by phone. Offers made by MILPAU are non-binding.
The accommodation contract is concluded upon MILPAU’s written booking confirmation. The reservation only becomes legally binding once the confirmation has been received and the deposit under Section 3 has been paid.
There is no entitlement to accommodation in a specific apartment unless a particular unit has been expressly confirmed.
Section 3 Payment terms, default and reminder fees
A deposit of 30% of the total amount is due immediately upon receipt of the booking confirmation. The remaining amount must be credited to MILPAU’s account no later than 30 days before arrival.
For short-notice bookings, meaning less than 30 days before arrival, the full invoice amount is due immediately upon receipt of the invoice.
In the event of late payment, MILPAU is entitled to charge statutory default interest, currently 5% above the base rate. A reminder fee of EUR 15.00 will be charged for each reminder sent after default has occurred. Costs of debt collection, including collection agency fees, are borne by the customer.
MILPAU accepts payment by bank transfer, PayPal or credit card. Cash payments are not accepted. Bank fees, especially for international transfers, are borne entirely by the guest.
MILPAU may require a deposit or security of up to EUR 250.00 before handing over the apartment, for example by pre-authorising a credit card.
Section 4 Arrival and departure (check-in / check-out)
The apartment is available from 3:00 p.m. on the day of arrival. There is no entitlement to earlier availability.
On the day of departure, the apartment must be vacated and returned in proper condition by 11:00 a.m.
For an unapproved late check-out, MILPAU charges EUR 30.00 per commenced hour. Departure after 2:00 p.m. will be charged at the full nightly rate for an additional day.
A fee of EUR 40.00 is charged for the loss of a key, key card or parking permit. MILPAU reserves the right to claim any additional costs, for example for replacing a locking system where necessary for security reasons.
Section 5 Digital identity verification and registration obligations
To comply with the statutory registration obligations under Sections 29 and 30 of the German Federal Registration Act, the guest must provide MILPAU with a valid identification document, meaning an identity card or passport, in digital form before arrival.
MILPAU uses software solutions for fraud prevention. If the guest’s identity cannot be verified without doubt, MILPAU is entitled to cancel the booking.
Section 6 Use of the apartment and inventory
The apartment is handed over in a clean condition. Any defects or damage to the inventory must be reported to MILPAU immediately after check-in.
The guest is liable for all damage caused by the guest or accompanying persons, for example broken glass, furniture damage or stains on textiles.
The inventory must be handled with care and is intended solely for use within the apartment. Rearranging furniture, especially moving beds, is expressly prohibited.
The apartments may only be occupied by the number of persons confirmed in the booking. Over-occupancy or transfer to third parties entitles MILPAU to terminate the contract without notice and without refunding the rental price.
Section 7 Non-smoking policy, parties and house rules
A strict non-smoking policy applies in all MILPAU apartments. This also includes e-cigarettes, shishas and tobacco heaters. In the event of a violation, MILPAU will charge a special cleaning fee of at least EUR 500.00 net.
Parties and gatherings are strictly prohibited. In the event of a violation, MILPAU is entitled to immediate termination and eviction; in addition, a contractual penalty of EUR 500.00 becomes due.
Quiet hours must be observed from 10:00 p.m. to 7:00 a.m. TV and audio devices must be kept at room volume.
To protect the property and the neighbourhood, apartments may be equipped with decibel sensors. These do not record conversations, but serve to detect excessive noise. Video surveillance may also be present in hallways and common areas.
Section 8 Pets
Pets are only permitted with MILPAU’s prior written consent and against an additional fee.
Animals brought without approval entitle MILPAU to charge a cleaning fee of up to EUR 300.00 net.
Section 9 WiFi and internet use
MILPAU provides internet access via WiFi. Use is at the guest’s own risk. MILPAU does not assume liability for damage to devices, for example due to viruses, or for data loss.
Access credentials may not be passed on to third parties.
The guest is obliged to comply with applicable law when using the connection. In particular, the use of file-sharing programs, meaning peer-to-peer services, the download of copyrighted content and access to unlawful websites are prohibited.
The guest shall indemnify MILPAU against all third-party claims and legal defence costs resulting from unlawful use of the WiFi connection by the guest or third parties acting with the guest’s knowledge.
Section 10 Cancellation and withdrawal by the guest
Cancellations must be made in text form. If the guest withdraws from the contract, the following compensation applies:
- Up to 7 days before arrival: 60% of the agreed price.
- Up to 3 days before arrival: 90% of the agreed price.
- From 1 day before arrival or in the event of a no-show: 100% of the agreed price.
Section 11 Cancellation and termination by MILPAU
MILPAU is entitled to withdraw from the contract for objectively justified reasons, in particular in cases of force majeure or unforeseeable damage to the rental property. In this case, liability is limited to refunding amounts already paid.
MILPAU may terminate the contract without notice if the guest disturbs the peace despite warning, uses the apartment improperly or breaches essential provisions of these terms and conditions.
Section 12 Liability of MILPAU
MILPAU is liable with the diligence of a prudent merchant. Liability for damages not resulting from injury to life, body or health is limited to the typical foreseeable contractual damage unless intent or gross negligence exists.
MILPAU is liable for brought-in property in accordance with statutory provisions under Sections 701 et seq. of the German Civil Code. For money, valuables and precious items, liability is limited to EUR 800.00 unless a separate written agreement has been concluded.
Section 13 Communication via WhatsApp and live chat
MILPAU uses WhatsApp Business and live chat modules for fast guest communication. By using these channels, the guest agrees to the processing of their data in accordance with the privacy policy.
Section 14 Final provisions
There are no oral side agreements. Amendments require text form.
Place of performance and payment as well as exclusive place of jurisdiction for all disputes is Recklinghausen, Germany.
Should any provision of these terms and conditions be invalid or void, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose intended.
